Decision Tree III:

Does the information (i.e., technology or technical data) you seek to disclose qualify for at least 1 of the 3 exclusions from U.S. export controls, such that you may freely transfer it to anyone abroad or in the United States?

You should consult this Decision Tree if you plan to:

  • Transfer abroad, by shipment, hand-carrying, or electronic means, unpublished technology or technical data; OR
  • Disclose, by verbal, written, or electronic means, unpublished technology or technical data abroad or to a non-U.S. person in the United States.

Frequently Asked Question Relating to this Decision Tree:

  • Does this Decision Tree address Third Party Information, i.e., information generated and/or provided to Cornell employees by outside parties? No.

    This Decision Tree does not address Third Party Information, because such information is always controlled. Please notify your project's Grant & Contract Officer (GCO) at Sponsored Programs Services whenever a third party (such as a sponsor or vendor) seeks to provide you with unpublished information.

    Your GCO will work with ORIA to take the steps necessary to ensure that your team receives any export-controlled information in a way that maintains the project's status as fundamental research.
