"Software" includes encryption software in either source code or object code. You may only freely export non-encryption software that is available for general public distribution for free or at a reasonable price.
The U.S. government is especially concerned about the export of software relevant to any form of encryption. The EAR define “advanced encryption software” as computer programs that provide capability of encryption functions or confidentiality of information or information systems and that have a symmetric key length exceeding 56-bits. It includes source code, object code, applications software, and system software.
Before transferring advanced encryption software, or software directly related to a military item or spacecraft, please contact ORIA, even if that software is public.
