Regulatory Updates
In recent years, the federal government has proposed regulatory changes that affect the conduct, administration, and openness of university research programs. These changes purport to decrease the perceived national security risk of foreign national participation in these programs. The university community has fought hard against these changes, warning the government against compromising the spirit of academic freedom and inclusion that for decades has advanced the nation scientifically, economically, and diplomatically.
Our efforts have been highly effective. For example, from 2005-2006, the university community deluged the Department of Commerce (DOC) with comments advocating the withdrawal of a regulatory change that would have subjected the research activities of foreign-born researchers to many new license requirements. The DOC received more comments to this proposed rule than to any other in its history. The proposed rule was withdrawn.
Instead, the DOC formed the Deemed Exports Advisory Committee in October 2006, which includes prominent members of the academic and business communities. The Committee is working to address export controls compliance by research universities in a way that minimizes administrative burdens and continues to foster the open exchange of ideas that has been our hallmark.
